Would you stand idly by and allow somebody to kill your brother, sister or wife and children?  Do you want anyone to die a slow and agonizing death?  Would you kill someone that believes in and depends on you?  What about your priest, pastor, imam or rabbi?  Would you want to murder someone that has supported you even to the point of giving you money?  If your answer is an unequivocal no on all counts, then you are a human being and not a depraved-heart murderer.  The definition of murder is “the premeditated killing of another human being.”  It matters not if the death comes quickly or slowly, the act is still murder.  And, if you use these questions as a standard for judging human beings, you will find that anyone not in agreement with your assessment is either mentally ill or a cold-blooded murderer.  Whether that person kills you quickly using a knife or a gun or slowly over a period of months or years, if the death is caused by that person’s actions with the intent to murder you or not, the end result is still murder and that person is the murderer according to U.S. federal, state and local laws.  Sadly, in 2017 we were warned that Trump may be that person when “27 Mental Health Professionals Declared Trump Mentally Unstable.”  According to U.S. law, if Trump the recently self-proclaimed “chosen one” is not a murderer, he may soon become one.  Based upon his actions and policies, he has proven that he wants many poor and middle-class Americans dead.

 

Just what would you do to someone that poses this kind of danger to you and your family?  As a sane human being, you would have no choice but to defend your family at all cost, even if it means self-sacrifice or committing justifiable homicide.  No one would expect less of you or of themselves.  By all accepted societal norms, you would be considered a hero.  Yet, despite the possible actions that you may take in defense of your family, flaunting all standards of humanity, the murderer moves forward with his plan and actions to kill you and your family.  This murderer’s plan is to make your family suffer and die horrible, agonizing deaths from illness, which is tantamount to attacking you with deadly biological and chemical agents.  This murderer wants you to suffer while you watch the slow, agonizing and very painful deaths of your loved ones.  Regardless of this murderer’s station or status in life, these actions are proof of extreme hatred for you, your family and friends.  Since you don’t know this person and there has been no robbery attempt or assault by you upon this person, there can’t be any other reason for this murderer’s unprovoked attack other than blind hatred.  So, now you must determine what to do about this person who by the common sense standards established from answering the aforementioned questions, is a cold-blooded murderer.

 

While you ponder your family’s fate and try to decide your course of action, this murderer strikes you with the terror of forcing your mother, father and yes, your grandparents to become crippled or go blind and eventually die slowly and painfully without basic medical care or life-saving drugs.  By definition, this murderer is a terrorist.  This sadistic monster does not have any compassion for the young, old or the infirmed.  Even by Hitler’s and Stalin’s standards, this murderer is evil.  When so-called-president Donald J. Trump takes away your healthcare, by his deliberate actions, he becomes that terroristic murderer.  And, by taking away your healthcare, he is executing his plan to terrorize and murder you and everyone that you love and care about.  Trump, by your own assessment of his wanton need to cruelly destroy you and everyone in your life, is a cancerous plague on humanity whose only purpose by self-admission is the evil destruction of those that he perceives to be his enemies or considered by him to be of lesser value than himself.  Regardless of how he or his fellow Republican and accomplices try to spin it, in realistic terms, they hate you.  There is no other explanation for such inhumanity and sadism.  It is time to face the cruelty of the facts that are staring you in the face.  “Trump Wants You Dead” and due to your belief in his 27,000 plus lies and counting, he thinks that you are either too stupid to see it or too weak to do anything to stop him.  Welcome to Trump’s America, Trump-land.

 

 

In October of 2017, Trump declared: “Obamacare is finished,” Trump told reporters before a cabinet meeting. “It’s dead.  It’s gone.  You shouldn’t even mention it. It’s gone. There is no such thing as Obamacare anymore.” “dead, It’s gone. There is no such thing as Obamacare any more’” This was followed by a Trump led Senate attempt to repeal The Affordable Care Act (ACA), Obama Care.  The vote failed by one vote when Republican Senator John McCain, the senior Senator from Arizona opposed the president and voted a resounding no.  On the 2016 campaign trail, Trump promised supporters that he would repeal the ACA and replace it with “something much better for everybody.”  In October of 2017, Trump ended “cost-sharing reduction” (CSR) payments to insurance companies that help subsidize insurance for millions of lower-income Americans.  His decision to end CSR payments followed Presidential Executive Order 13813{1}, “Promoting Healthcare Choice and Competition Across the United States.”  This order also, allowed insurance companies to sell plans that fall short of coverage requirements under the Affordable Care Act.

 

 

The history of the Republican Party’s attempts to end healthcare for American’s not covered by employer-provided insurance did not start with Donald Trump.  As of July 27, 2017, there have been at least 70 Republican-led attempts to repeal, modify or otherwise curb the Affordable Care Act since its inception on March 23, 2010.  Two years later in June 2012, the Supreme Court decided in a 5–4 vote that the Act is constitutional which led the way for its implementation. The Patient Protection and Affordable Care Act aka the Affordable Care Act, is considered the most important legislation passed by the US Congress since the creation of Medicare and Medicaid in 1965 which was a law passed under President Lyndon Baines Johnson’s administration.  Johnson was a Democrat as is Obama.

Most recently, on March 26th, despite objections from cabinet members, Health and Human Services Secretary Alex Azar and Attorney General William Barr, Trump publicly announced his decision to launch a new campaign to overturn Obama Care. On Monday, March 25th, in a two-sentence letter to a federal appeals court, Attorney General William Barr explained that the Department of Justice was reversing the administration’s opposition to a lawsuit opposing the Affordable Care Act.  In the letter, the Justice Department said the court should affirm a judgment issued in December by Judge Reed O’Connor of the Federal District Court in Fort Worth, Texas:

Judge O’Connor’s opinion stated that the individual mandate requiring people to have health insurance “can no longer be sustained as an exercise of Congress’s tax power” because Congress had eliminated the tax penalty for people who go without health insurance.  Judge O’Connor continued with, “the individual mandate is unconstitutional” and the remaining provisions of the Affordable Care Act are also invalid.

 

 

In 2017, the individual mandate portion of Obama Care was repealed as a provision of the Trump Tax Cuts and Jobs Act, tax reform law.  Because of the dissolution of the individual mandate, the Trump administration believes that this will invalidate the Affordable Care Act.  In other words, the letter is saying that the Trump administration feels that the entire law should be struck down.  This new Justice Department position is unprecedented because it is the Justice Department’s job to defend all federal laws that are being challenged in a court of law.   As foreseen by legal experts and many States Attorneys Generals, this new attack on the Affordable Care Act’s existence will be challenged in a Supreme Court Case.  But, without the government doing its job to defend the law, just who would defend Obama Care remains to be seen.

 

 

All of these actions on the part of Trump and the Republican party, if successful would leave millions of people without health insurance and allow health insurance companies to once again, deny people with pre-existing conditions healthcare coverage.  This would leave any sane person to believe that Trump and the Republican Party are out to kill people.  While the common sense analysis that “Trump Wants You Dead” may appear to be simplistic, insane or an unrealistic conspiracy theory, there is a basis in U.S. law that invalidates these assertions.  U.S. law is based upon common sense understandings of right and wrong as understood by the common folk.  This is called common law.  However, statutory law or statute law is a written set of laws established by a legislative body, either, federal, state or municipal.  It is statutory law which is based upon common laws that allow for law enforcement which includes arrest, trial and incarceration or vindication.

 

In U.S. statutory law on federal, state and local levels there are crimes known as depraved-indifference and depraved-heart murder.  According to “Duhaime’s Law Dictionary” also referred to as depraved-mind murder is an act: where an individual is evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person, and thereby caused the death of another person{2}.

 

Nationally, state-level Appeals Courts and Supreme Courts have made the following or similar rulings{2}:

  1. In Robinson v State, Justice Adkins of the Court of Appeals of Maryland relied on this extract of extant jurisprudence: “Depraved heart murder is the form of murder that establishes that the willful doing of a dangerous and reckless act with wanton indifference to the consequences and perils involved, is just as blameworthy, and just as worthy of punishment, when the harmful result ensues, as is the express intent to kill itself. This highly blameworthy state of mind is not one of mere negligence. It is not merely one even of gross criminal negligence. The common law treats such a state of mind as just as blameworthy, just as anti-social and, therefore, just as truly murderous as the specific intents to kill and to harm.”
  2. In Windham, Justice Prather of the Supreme Court of Mississippi adopted these words: “The killing of a human being without the authority of law by any means or in any manner shall be murder … when done in the commission of an act eminently dangerous to others and evincing a depraved heart, regardless of human life, although without any premeditated design to effect the death of any particular individual….[D]epraved-heart murder involves a higher degree of recklessness from which malice or deliberate design may be implied… “Under the traditional view, death which resulted from a reckless act directed toward a particular individual would not be deemed to be within the scope of depraved-heart murder statutes. To constitute depraved-heart murder, the act must have manifested a reckless indifference to human life in general.”
  3. In Substantive Criminal Law, the authors described depraved-heart murder as: “Extremely negligent conduct, which creates what a reasonable man would realize to be not only an unjustifiable but also a very high degree of risk of death or serious bodily injury to another or to others – though unaccompanied by any intent to kill or do serious bodily injury – and which actually causes the death of another, may constitute murder.”
  4. In People v Register, Justice Simons of the New York Court of Appeals wrote: “(A) depraved mind murder … conviction must be supported by evidence that defendant under circumstances evincing a depraved indifference to human life recklessly engaged in conduct which created a grave risk of death to another person, and thereby caused the death of another person. A person acts recklessly when he is aware of and consciously disregards a substantial and unjustifiable risk, but to bring defendant’s conduct within the murder statute, the People were required to establish also that defendant’s act was imminently dangerous and presented a very high risk of death to others and that it was committed under circumstances which evidenced a wanton indifference to human life or a depravity of mind. The crime differs from intentional murder in that it results not from a specific, conscious intent to cause death, but from an indifference to or disregard of the risks attending defendant’s conduct.”

It is an accepted principle that all government officials act on behalf of the public-good.  However, in Trump-land this has been proven to be false.  Any sane individual including judges and justices would view the actions of Trump as dangerous and the result of a depraved-mind or depraved-heart.  Although these court rulings do not mention government officials and their actions, they do not exclude them.  In studying the law as it is laid out by these court rulings, it is safe to say that in so-called-president Donald Trump’s desire to kill the Affordable Care Act he wants to be a murderer.  If he is successful you can label him as such.  Also, if you take into account Trump’s immigration policy where children are separated from their parents in an attempt to deter his unwanted immigration of Hispanics and Latinos, there is no better example of a depraved-mind.  According to ICE officials, literally thousands of children suffered this fate and many of them will never be reunited with their parents.  A depraved-mind is most definitely unstable but according to legal precedence, this does not constitute mental illness.  The depraved-mind or depraved-heart is morally deficient and evil at its core.  Throughout history, we have had other examples of people that committed depraved-heart murders.  Rulers such as Genghis Khan, Ugandan President Idi Amin Dada murdered 300,000, Germany’s Adolph Hitler killed 17 million, Joseph Stalin of Russia murdered over 20 million and also the sadistic, sexually perverted Roman Emperor Gaius Caesar known as Caligula whom Trumps appears to share some of the same sexual appetites with.

While Trump’s sexual exploits with porn stars, personal exclamations about the size of his hands and other body parts and innumerable accounts of erratic behavior have become acceptable by his base, it has not gone unnoticed by America’s most noted psychologist and mental health professionals.  In a September 28, 2017 article “The Dangerous Case of Donald Trump”{3} published by Psychology Today, the article discusses a book of the same title which was based upon Psychologist and Professor Brandy Lee’s publication of statements and essays by 27 noted Mental Health Professionals that felt the need to warn the nation about the dangers posed by Donald Trump whom these 27 mental health professionals deemed mentally unstable.  Lee also briefed a dozen members of Congress — 11 Democrats and 1 Republican — on the president’s mental state.  No other Republicans wanted to attend the briefing.

 

 

The article also covered John Gartner, Ph.D., founder of Duty to Warn{4}, an organization intent on warning our country that we are in dire trouble due to our president’s mental instability.  More than 60,000 mental health professionals have signed John’s petition, which states:

“We, the undersigned mental health professionals, believe in our professional judgment that Donald Trump manifests a serious mental illness that renders him psychologically incapable of competently discharging the duties of President of the United States. And we respectfully request he be removed from office, according to article 4 of the 25th amendment to the Constitution, which states that the president will be replaced if he is ‘unable to discharge the powers and duties of his office.’”

As evidenced by the actions of the Republican Party and those of the so-called-president, by legal definition, these elected officials are suffering from depraved-minds.  Another example that supports this evidence is the so-called president’s budget for next year.  This budget champions cuts to social security, Medicaid and Medicare.  Social Security provides pensions to the elderly and death benefits to children whose parents have died.  Medicaid provides health insurance to the poor while Medicare provides health insurance to individuals 65 years of age and older.  These cuts would reduce the healthcare benefits thus causing an adverse impact on the health of the most vulnerable Americans.  These budgetary actions on the part of the Republican Party and so-called-president Trump along with their long legal battles to repeal healthcare forces one to view their actions as possibly being evil or depraved.   If implemented, rest assured the Republicans and Trump will kill people.

 

 

The battle for the soul of our nation is over.  It has escalated into a war to save the very lives of you and your loved ones.   So, it is time to revisit the initial questions.  Would you stand idly by and allow somebody to kill your brother, sister or wife and children?  Do you want anyone to die a slow and agonizing death?  Would you kill someone that believes in and depends on you?  What about your priest, pastor, imam or rabbi?  Would you want to murder someone that has supported you even to the point of giving you money?  Well, this is exactly what the Republicans and Trump are attempting to do.  These people no longer practice, believe in or enforce the laws of this country which they are sworn to uphold and defend.  With impunity, they are viciously trying to destroy them.  Our nation’s laws have a name for what they are doing.  It is called depraved indifference, depraved-mind murder or depraved-heart murder.
