The founding fathers with great care and all of their wisdom through their invention of the constitution created one of the greatest countries in the world.  However, despite being visionaries, they could not see 250 years into the future.  And, because of this, they inadvertently created the first American Tyrant, so-called-president Donald J. Trump. The title of this article, “Justice In America Terrifyingly Real Part II,” describes the state of justice in America as of the year 2019.  It is also a look at what the future will look like if the constitutional powers granted to the Executive Branch go un-amended.

Like any agent of a foreign power promoting the interest of his master, Donald Trump having been aided by and to the benefit of Vladimir Putin is solidifying his position.  It does not matter if his justice department found no proof of collusion or conspiracy between the two.  The fact remains.  It is undeniable.  Despite their denials, Putin helped Trump win the election.  It did happen.  And through his abuse of the judicial process and aided by the refusal of the Republican lawmakers in Congress to discharge their duties of oversight, Trump is using the justice system as a force multiplier to inflict terror upon the American people and distract them from his true intentions.  Trump has seized power and become a Tyrant.  “We know that no one ever seizes power with the intention of relinquishing it.” – George Orwell, 1984. 

Donald Trump throughout his tenure, administration appointees and policies has proven his Tyranny by refusing to abide by the rule-of-law.  And, with the populist support of Trumpites and Republican Congressional minions, he is not planning to relinquish it.  After all, this is America and dictatorship is impossible, right?  So, is it hard to believe that like any dictator, he has surrounded himself with family members for the purpose of family succession to power?  If you don’t believe that this is possibly true, then you are invited to provide Xplicit News with a more logical reason for the nepotism in his administration.   We pledge to publish the reason and a very heartfelt rebuttal.  In many ways, America is not unlike the Weimar Republic.  The Weimar Republic is a historical designation of the German State from 1918-1933.  In 1933, Adolph Hitler came into power.  The German Republic fell and the country became a Fascist nation.  Right now, the American Zeitgeist mirrors that of 1933 Germany and the abuse of the American justice system by Donald Trump has become the gateway for our demise.

In military terms, a force multiplier refers to a factor or a combination of factors that gives weapons or personnel the ability to accomplish greater things than without it.  Hence, in a land where the rule-of-law is outlined in a written constitution, it is essential to take control of as many elements involved with the administration and enforcement of the law to establish a coup.  That control is accomplished by abusing the system of justice.  This abuse of the judicial system is possible because the constitution was based upon two founding principles that were endemic to the very souls of the Founding Fathers themselves.  They are the rule-of-law which means that no man is above the law and patriotism.  They could not fathom that one day an individual without either of those qualities could ever hold the highest office in the land.  They believed that most people eligible to hold public office would be decent, patriotic human beings with a desire to do the right thing.  If not, then the constitution would root them out and protect the nation.

Because of the rule-of-law, they felt that enforcement of the law should be placed under the Executive Branch.  So, they gave it very broad powers.  Despite the law enforcement powers given the Executive Branch which included the appointment of judges and justices, the founders placed the power to oversee the Executive Branch with the Congress.  Also, the power to oversee Congress was given to the judicial branch.  All three branches of government were created as co-equal branches.  The flaw in their creation was glaring yet unimaginable.  Unimaginable because in a democratic republic, via the constitution, majority rules.  They never envisioned that two co-equal branches of government would become corrupt and rule over the third branch or render it powerless.  Such is the case in Trump-land today.  This flaw has led to the terrors created by our system of justice under the first American tyrant, Donald Trump.

Tyranny occurs when a ruler has absolute power.  In such, control of the judicial system is imperative for tyranny to succeed.  In essence, the founding fathers created the Tyranny of Donald Trump by giving the presidency the power to appoint political allies to judicial positions.  Through the power of political appointments, corrupt judges and Supreme Court Justices have free reign to advance the political ideologies and wishes of a corrupt president through their interpretations of the law.  Their rulings can strike down existing laws, while their interpretations can mold the manner in which laws are enforced or not enforced.  Their administration of justice through sentences has set wealthy or well-connected individuals and criminals free while sentencing the poor and less fortunate with inhumane penalties and or incarcerations.  Throughout history, their interpretations of the constitution have promoted slavery, embedded Jim Crow laws into our society, denied women the right to vote, facilitated the racist inhumane implementation of the death penalty and now the justice system is allowing the tyranny of Donald Trump to strike terror into the hearts and souls of the American people.

According to the Greek philosophers Plato and Aristotle, the rule of law is the principle that no one is exempt from the law, even those who are in a position of power. The rule of law can serve as a safeguard against tyranny because just laws ensure that rulers do not become corrupt.  These are the principles that the Founding Fathers believed in when they drafted the constitution.  But if the leader of a nation is allowed to appoint the people that will judge him as is the case with Donald Trump, the system falls apart and tyranny is the result.

Throughout Trump’s tyrannical administration, he has proven the following to be true.  1.) In a tyrannical government, the ruler becomes corrupt and uses his power to further his own interests instead of working for the common good.  2.) A terrorist is a person who uses unlawful violence and intimidation, especially against civilians, in the pursuit of political aims.  3.) “True terror is realizing that the leader of your country is a psychopathic eleven-year-old bully that people are too scared of to hit in the mouth” – Anonymous source.

According to the Society for the Study of Psychopathy, Donald Trump is a psychopath.  The traits of a psychopath include^{1):

• Lack of guilt/remorse
• Lack of empathy
• Lack of deep emotional attachments
• Narcissism
• Superficial charm
• Dishonesty
• Manipulativeness
• Reckless risk-taking

Justice in America is determined by three factors.  These factors are the creation of fair and just laws by the Legislative Branch, the interpretation and administration of those laws by the Judicial Branch and the enforcement of the laws by the Justice Department under the control of the Executive Branch.  Because President Trump selects the Federal Prosecutors, Judges and Supreme Court Justices, they have been chosen to enforce his beliefs, ideology and wishes even if it means bending of violating the rule-of-law.  This means that the operations of the Justice Department are subject to the personal opinions, corruption, cronyism and politics of people that owe their livelihood to the president.

Under the terroristic rule of a psychopathic Donald Trump, “American Justice is Terrifyingly Real.”  The proof is evidenced by his Attorney Generals, judicial appointments actions and others in his administration.

Jeff Sessions era:

1. Sessions overturns President Obama’s decision to stop using private prisons to house federal convicts.
2. Sessions directed the Justice Department to withdraw a guidance issued in 2016, requiring public schools to allow transgender students to use bathrooms corresponding to their gender identity.
3. Sessions rescinded a policy memo issued by the Obama administration that said the 1964 Civil Rights Act’s employment discrimination prohibitions applied to transgender people.
4. Sessions enforced Trump’s controversial policies: cutting off federal funding to so-called sanctuary jurisdictions, cities and counties that limit cooperation with federal immigration authorities.
5. Sessions reversed Obama-era reform agreements between the Justice Department and police agencies: “It is not the responsibility of the federal government to manage non-federal law enforcement agencies.” a dozen such court-enforced “consent decrees” were struck between the Obama Justice Department and local police departments “
6. Sessions ordered federal prosecutors to “pursue the most serious, readily provable offense” with the lengthiest sentences in all criminal cases.
7. The Sessions Department of Justice announced reopened an investigation into Harvard University’s use of race in its admissions policy with the intent of violating a Supreme Court Ruling that allowed affirmative action policies widely practiced by American universities and colleges.
8. On Dec. 21, 2017 Sessions rescinded an Obama Justice Department letter advising local courts against hitting indigent defendants with stiff fines and fees.
9. Sessions refused to fight the Trump Muslim ban of 2017 and enforced the policy of separating immigrant children from their parents and putting them in cages. He also refused to advise the President against the illegal use of Troops to enforce immigration policies.

William Barr era:

1. Under the George H.W. Bush administration, Barr helped to pardon more than a Reagan Officials being investigated or found guilty in the Iran Contra Affair
2. Barr sent a 24 page letter to the Justice Department declaring that Trump could not commit obstruction-of-justice. Which means that in Barr’s opinion, Trump is above the law.  Obstruction-of-justice^{2} is defined as an act that “corruptly or by threats or force, or by any threatening letter or communication, influences, obstructs, or impedes, or endeavors to influence, obstruct, or impede, the due administration of justice.”
3. Despite his letter to the Justice Department which showed that he had a conflict of interest with the Mueller investigation and showed bias towards the President, in a Senate hearing, Barr refused to recuse himself from the investigation
4. In violation of the law, Barr refused to turn over the Mueller Report and all evidence to Congress and declared Trump innocent of obstruction-of-justice
5. Under Trump’s orders, Barr has refused to defend the Affordable Care Act which by law is his responsibility
6. Barr in violation of laws has asked the courts to declare the Affordable Care Act illegal
7. Barr during a Senate hearing declared that the FBI illegally spied on the Trump campaign and stated that he will investigate the FBI. He admitted to the Senate that he did not have any proof to support his allegations
8. Donald Trump threatens to dump immigrants on the streets of Sanctuary Cites without going through due-process and Barr does not object
9. On April 11, 2019, Trump tells the new Acting Secretary Homeland Security Kevin Aleenan to break the law by enforcing his immigration policies and closing the southern border and he will be pardoned by Trump if he is convicted of the crime. Barr refuses to rebuke Trump or advise him against breaking several laws involved with this offense.

Trump Supreme Court Appointments

Associate Supreme Court Justice Neil Gorsuch is a firm believer in the constitution as it was originally written.  The constitution in its original form stated that slaves were 3/5^th of a human being.  It also did not give slaves and civil rights or the right to vote.  As a Federal Appeals Court Judge, many of his decisions involving civil rights issues were contrary to human rights and on corporate issues he always favored corporate interests.  This left him with the public perception of being an elitist or a judge for the elite.  He has questioned the principle of  ‘one man one vote,’ expressed a willful desire to uphold Trump’s illegal Muslim travel ban, and ruled against the rights of LGBTQ Americans and civil rights plaintiffs.

Associate Supreme Court Justice Brett Michael Kavanaugh assumed office on October 6, 2018, after an unprecedented Senate hearing where he verbally attacked Democratic members of the committee for their criticism of his alleged sexual assault of a high school girl which occurred when he was a college student.  Psychology Professor, Dr. Christine Blasey Ford testified before the Senate detailing the assault upon her.  She was sharply ridiculed and criticized by Republican members of the committee after the committee session ended.  Julie Swetnick, a current government employee with several security clearances was also allegedly assaulted byKavanaugh.  In retaliation, after she did not testify, Republican members of the Senate referred Julie Swetnick to federal officials for criminal investigation regarding a potential “conspiracy” to provide false statements to Congress and obstruct its investigation into the sexual misconduct allegations levied against Kavanaugh.

In a 2009 Minnesota Law Review Article^{3}, Kavanaugh had written that “Congress might consider a law exempting a President — while in office — from criminal prosecution and investigation, including from questioning by criminal prosecutors or defense counsel.”  During the Senate hearing, Democratic Senator, Dianne Feinstein of California asked Kavanaugh if a sitting president could be compelled to respond to a subpoena, his response was: “I can’t give you an answer on that hypothetical question.”

In the article, “Government by Fear Hate Division and Corruption, The American Oligarchy”^{4} published on this site on April 10^th, a detailed analysis of the corruption, criminal activities and convictions of members of the Trump administration is provided.  Among these current and former corrupt officials are 5 former campaign officials, 6 Cabinet Secretaries, the former Ambassador to the United Nations and 5 other White House officials and Trump advisers.  Further evidence of corruption and of Trump’s refusal to obey federal laws stems from Secretary of the Treasury Steve Mnuchin’s refusal to surrender Trump’s tax returns to the Ways and Means Committee. The law, IRS Tax Code 2011, Section 6103^{5}, states that the tax returns “shall be turned over.”  Another law, US Tax Code 2009, Section 7125^{6}, states that any person or government official in violation of or participates in the violation of federal tax laws are subject to prison time and removal from office. The penalty will result in a $10,000 fine and a jail sentence of up to 5 years in prison. This includes the current President of the United States, Donald J. Trump.  To this date, Trump and the Treasury Secretary refuse to comply with the law.

Like all tyrants, Trump’s administration is rife with cronyism and criminals with contempt for the rule-of-law.  To remedy the problems of cronyism and partisanship that have infested and corrupted our system of justice, immediate and radical changes have to take place.  New laws governing the conduct along with periodic reviews of judiciary and law enforcement officials must be passed.  These laws must include harsh penalties for offenders.  The power to appoint individuals to these positions must be taken out of the control of the Executive Branch and placed under the control of the legislature.  The practice of lifetime appointments of judges and Supreme Court Justices must come to an end.  Other more modern checks and balances designed to meet the needs of an ever-evolving society have to be implemented.  But, for these changes to be implemented, Trump must be removed from office.  If not, he will most certainly use his veto power to prevent the changes.  Such broad sweeping reforms will demand that new amendments be added to the constitution which will require two-thirds of the states to ratify the changes.  Obviously, this will not happen overnight or without a fight.  If we don’t start now, it will never happen and generations to come will be doomed to suffer the terrors of other tyrants and psychopaths like Trump or perhaps even an Adolph Hitler.

In review of the behavior of a psychopath, according to Kelly McAleer, Psy.D,^{1}: “The psychopath is callous, yet charming. He or she will con and manipulate others with charisma and intimidation and can effectively mimic feelings to present as “normal” to society. The psychopath is organized in their criminal thinking and behavior and can maintain good emotional and physical control, displaying little to no emotional or autonomic arousal, even under situations that most would find threatening or horrifying. The psychopath is keenly aware that what he or she is doing is wrong, but does not care.”  This is an accurate description of history’s most infamous Tyrant of the 20^th century, Adolph Hitler.  It is also a factual assessment of the behavior of the current U. S. President Donald J. Trump as observed by mental health professionals and hundreds of millions of people on national and global television.

Trump has not yet completed his overthrow of the American government.  However, based upon his control over certain political factions, his abuse of power, disregard for the rule-of-law and his psychopathic nature, like Hitler, he is a Tyrant.  With American citizens as unsuspecting as their Weimar Republic counterparts, his ascension to power may not be far off.  At some time in the not-too-distant future, all of us may be forced to click our heels, use a straight arm salute and respond with a hearty exclamation of “Seig Heil mein Fuhrer!” “Heil Trump!”
